Anti-Sex Trafficking Policy
Last updated
Ember has zero tolerance for sex trafficking, the sexual exploitation of minors, and any related abuse. This policy explains what that means, how the Service is designed to make trafficking and exploitation impractical, what is prohibited, and how we detect, respond to, and report violations.
This policy supplements the Terms of Service, the Prohibited Content Policy, the Underage Policy, the Content Moderation Policy, and the Acceptable Use Policy. If any part of this policy conflicts with those documents, the more restrictive rule applies.
1. Zero tolerance
We do not allow the Service to be used, in any way, to recruit, advertise, transport, harbor, or obtain a person for commercial sex through force, fraud, or coercion, or to facilitate any commercial sex act involving a minor. This includes attempts, jokes, "roleplay" framings, and indirect or coded requests. Violations result in immediate permanent termination, evidence preservation, and reporting as described below.
2. What this policy covers
For purposes of this policy, sex trafficking and related exploitation include:
- recruiting, advertising, soliciting, transporting, harboring, or obtaining a person for commercial sex by force, fraud, or coercion;
- any commercial sex act, or advertisement for one, involving a person under 18, regardless of apparent consent;
- non-consensual sexual exploitation of a real person, including "sextortion" (threatening to share or create sexual content of someone unless they pay, provide further material, or comply with demands); and
- grooming, blackmail, or coercion directed at getting someone to engage in sexual activity or produce sexual content against their will.
3. Why the Service is structurally unsuited to trafficking
The Service is built so that trafficking and real-world exploitation have no practical foothold here:
- Everything depicted is synthetic. Outputs are AI-generated. No real performers are used, and no real person may be depicted or submitted as a reference image.
- No user-to-user contact. There is no chat, messaging, comments, or any other way for users to communicate with each other through the Service.
- No marketplace. There is no way to list, advertise, or sell any good, service, or "meet-up" through the Service.
- No contact or booking information. Character names, descriptions, and prompts cannot be used to publish contact details, prices, locations, or availability.
- No payouts to users. Coins cannot be cashed out, transferred, or exchanged for money, so the Service cannot be used to move or launder trafficking proceeds. See the Anti-Money Laundering and Anti-Fraud Policy.
These are deliberate design choices, not a substitute for the enforcement described below.
4. Prohibited uses
You must not use the Service to:
- advertise, solicit, or promote commercial sexual services, escort services, or in-person "meet-ups," whether through Outputs, public characters, prompts, or any other content;
- include contact details, handles, prices, locations, or availability in a character's name, description, image, or prompt;
- create content depicting a real trafficking victim or any real person in a sexual or exploitative context;
- attempt to depict, describe, or simulate a minor in a sexual, nude, suggestive, or fetishized context, including through euphemisms, misspellings, non-English terms, or non-photorealistic styles (see the Underage Policy); or
- groom, coerce, blackmail, threaten, or otherwise pressure any person into sexual activity or into producing sexual content, on or off the Service.
5. How we detect and respond
Detection. Every prompt is screened by an automated content-policy gate before generation, and uploaded reference images are screened for indicators that anyone depicted may be a minor. Public characters are additionally reviewed by human moderators, and users can report content or accounts at any time. See the Pre-Screening and Post-Screening Policy and the Content Moderation Policy.
Response. When we verify a violation of this policy, we act within 24 hours. Our response may include:
- immediate removal of the content and permanent termination of the account, without refund;
- preservation of the content, prompts, account information, and related records as evidence;
- a report to law enforcement, and, where minors are involved, a report to the National Center for Missing & Exploited Children (NCMEC) CyberTipline;
- a report to the National Human Trafficking Hotline at 1-888-373-7888 where trafficking indicators are present; and
- cooperation with law enforcement and regulators, including sharing account information where required by law.
6. Legal basis
This policy is grounded in, and intended to support compliance with, U.S. federal law, including 18 U.S.C. § 1591 (sex trafficking), the Trafficking Victims Protection Act, and the Allow States and Victims to Fight Online Sex Trafficking Act / Stop Enabling Sex Traffickers Act (FOSTA-SESTA), as well as equivalent anti-trafficking laws in other jurisdictions where the Service is available.
7. How to report
If you believe the Service is being used to facilitate trafficking or sexual exploitation, email legal@ember.xxx with the subject line "Urgent: trafficking" and as much detail as you can provide (account, character, or content involved, and what you observed). We acknowledge reports within 7 days and act on verified trafficking or minor-safety reports within 24 hours.
If someone is in immediate danger, contact local emergency services first. Additional resources:
- National Human Trafficking Hotline: 1-888-373-7888, or text 233733
- NCMEC CyberTipline: to report suspected child sexual exploitation
We do not retaliate against anyone who reports a suspected violation in good faith, even if our investigation does not confirm the report.
8. Staff awareness and policy review
Staff involved in moderation and trust and safety are trained to recognize trafficking indicators and to follow this policy's reporting steps. We review this policy periodically and update it as laws, threats, and our own moderation tooling evolve.
9. Contact
Questions about this policy, or reports of suspected trafficking or exploitation, can be sent to legal@ember.xxx.
