Underage Policy

The Service is for adults only. This Underage Policy explains who may use Ember, what we do if we learn a user is under 18, and our absolute prohibition on any content that depicts or presents a minor. It supplements the Terms of Service and works together with our Prohibited Content Policy, Pre-Screening and Post-Screening Policy, and Content Moderation Policy.

1. Who may use the Service

You must be at least 18 years old, and at least the age of majority in the place where you live, to create an account or use the Service. When you enter the site, you must confirm you are 18 or older before you can see or generate any content; this confirmation is a self-declaration that we store in a cookie for one year. Providing false age information violates the Terms of Service and this Policy.

2. Region restrictions and age verification

Some jurisdictions require age verification before a user can access adult content. We block access to the Service entirely from those places, currently including the United Kingdom, France, Germany, Italy, Australia, Brazil, and certain US states. This list changes as laws change, and we may add or remove jurisdictions at any time without notice.

We do not currently run identity-based age verification for all users. We may introduce third-party age verification in the future, and we may require you to provide proof of age at any time, including during an investigation or where a payment partner or applicable law requires it. Attempting to bypass a region block, a self-declaration, or an age-verification requirement, including by using a VPN or false information, is itself a violation of the Terms of Service.

3. If we learn a user is under 18

If we learn or reasonably believe that an account belongs to someone under 18, we will terminate the account immediately. Any Coins on the account are forfeited, and no refund is given for prior purchases. We delete the personal data associated with the account, except information we are required to keep for legal, safety, or investigative purposes. Where we believe it is appropriate, we may notify a parent or guardian, or notify law enforcement, consistent with Section 8 below.

4. Parents and guardians

If you believe a minor has created or is using an account on the Service, email legal@ember.xxx with the account details you have (username, email, or any content links). We will investigate promptly, terminate the account if the report is confirmed, and delete the associated data as described in Section 3.

We also encourage parents and guardians to use device-level or network-level parental control software to prevent minors from accessing adult sites in general. Ember labels the Service as adult content so that filtering and parental-control tools can identify and block it.

5. Absolute prohibition on content involving minors

We do not permit any content, in any form, that depicts or presents a person who is, appears to be, or is described as under 18 in a sexual, nude, suggestive, or fetishized context. This applies regardless of medium or style, including photorealistic images, anime or cartoon styles, characters described as "aged up," text descriptions, and character names or personas that imply a minor. It makes no difference whether the character is fictional; apparent age controls, not claimed age.

Every prompt is screened before generation. Wording that is age-ambiguous or youth-coded is rewritten so that every person described is explicitly an adult, or the prompt is blocked outright if it cannot be made compliant. Reference images are screened separately: any image in which a person appears possibly under 18 is rejected and cannot be used, regardless of the uploader's stated intent. 6. Detection, logging, and enforcement

Every blocked prompt or reference image is logged with the content, the reason for the block, the account involved, and the time, so we can detect patterns and respond to lawful requests. A single deliberate attempt to generate content that sexualizes a minor results in immediate, permanent termination of the account, with no refund of any Coins or payments. 7. Generated content and the law

Content that appears to depict a minor in a sexual context is illegal to create, possess, or distribute in the United States and many other countries, even when it is entirely computer-generated and no real child was involved. We treat such content exactly the same as content depicting a real minor: it is prohibited, it triggers enforcement, and it is reported as described below. Our 18 U.S.C. § 2257 Exemption Statement explains why the Service does not use real performers; it does not affect this prohibition in any way.

8. Reporting to authorities

When we identify apparent child sexual abuse material or a deliberate attempt to create it, we preserve the content and related evidence, report it to the National Center for Missing and Exploited Children through its CyberTipline, and cooperate with law enforcement anywhere in the world. We may share account information, including identifying information, with law enforcement and other authorities as required or permitted by law.

9. How to report a concern

If you believe an account, a public character, or any content on the Service involves a minor, email legal@ember.xxx with the subject line "Urgent: minor." Include the account name, character name, or link, and any details that will help us investigate. Do not download, save, or forward the material to us or anyone else; describe it instead. You can also report directly to the National Center for Missing and Exploited Children's CyberTipline or to your local law enforcement at any time.

10. Timelines and appeals

We act on verified reports involving minors within 24 hours of verification. Confirmed decisions to terminate an account or remove content for involving a minor are final and cannot be appealed. If you believe an account was blocked or terminated in error, for example because an adult was mistakenly flagged, you may appeal that specific decision through our Complaint Policy.
